TERMS OF SERVICE

SECTION 1 – INTRODUCTION AND ACCEPTANCE

  • Scope: This agreement (“Terms”) governs your use of the REFLEXION GALLERIES PTY. LTD. website (“Site”) and purchase of soapstone sculptures (“Products”). By accessing the Site or completing a transaction, you agree to these Terms, our Privacy Policy, and all applicable laws.
  • Company Information: REFLEXION GALLERIES PTY. LTD. is registered in Australia (ABN: 123 456 789), located at 8 GRANDVIEW PARADE, EPPING NSW 2121, contactable at enquiries@galrefep.com or 0451-961-630.

SECTION 2 – ACCOUNT REGISTRATION

  • Eligibility: You must be at least 18 years old or have parental consent to use the Site. Provide accurate registration information and update it promptly.
  • Account Security: Protect your account credentials and notify us immediately of unauthorized use. We are not liable for losses from account misuse.

SECTION 3 – INTELLECTUAL PROPERTY

  • Ownership: All content on the Site (images, descriptions, designs) is © REFLEXION GALLERIES PTY. LTD. or its licensors. You may not reproduce, modify, or distribute this content without written permission.
  • Product Designs: Soapstone sculptures are original works of art protected by copyright. Resale or commercial use of Products requires our prior consent.

SECTION 4 – USER CONDUCT

  • Prohibited Activities: Do not:
    • Use the Site for illegal purposes (e.g., money laundering, fraud).
    • Interfere with Site functionality (e.g., hacking, spamming).
    • Impersonate others or post misleading information.
    • Infringe on third-party rights (copyright, trademark, privacy).
  • Content Submissions: By posting reviews or comments, you grant us a royalty-free license to use, modify, and display your content.

SECTION 5 – ORDERS AND PAYMENTS

  • Order Confirmation: Orders are contracts between you and us. We may reject orders for reasons including inventory errors or suspicious activity.
  • Payment Terms: Prices are in AUD and include GST (where applicable). Payment must be made in full at checkout.
  • Custom Orders: Custom sculptures require a 50% deposit; the balance is due before shipping. Custom orders are non-cancellable once production begins.

SECTION 6 – PRODUCT WARRANTIES AND LIABILITY

  • Artisan Warranty: Products are warranted against manufacturing defects for 30 days. This includes cracks, chipping, or structural flaws not caused by misuse.
  • Limit of Liability: Our maximum liability for any claim is the purchase price of the Product. We are not liable for consequential damages (e.g., lost profits, emotional distress).

SECTION 7 – DISPUTE RESOLUTION

  • Formal Complaints: If dissatisfied, contact our Customer Support within 30 days to attempt resolution.
  • Mediation: Unresolved disputes will be referred to mediation through the Australian Small Business and Family Enterprise Ombudsman.
  • Governing Law: These Terms are governed by Australian law, and disputes are subject to the exclusive jurisdiction of Australian courts.

SECTION 8 – FORCE MAJEURE

  • Exception Clause: We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, strikes, supply chain disruptions).

SECTION 9 – TERM AND TERMINATION

  • Termination Rights: We may suspend your account for violations of these Terms. You may terminate by ceasing use of the Site.
  • Survival: Obligations that survive termination include payment, indemnity, and intellectual property rights.

SECTION 10 – AUSTRALIAN CONSUMER LAW COMPLIANCE

  • Statutory Rights: This policy does not exclude your rights under the Australian Consumer Law (ACL), including:
    • The right to a refund for major failures.
    • The right to have minor defects repaired or compensated.
